The Big Copyright Lie
Over on Coding Horror, Jeff is writing about The Big Copyright Lie of YouTube. Interesting read.
Well, I don’t know if it’s obvious to everyone, so here are my thoughts on this: It’s the cold war all over again. Just as with software patents. The policy of the big media companies - after the music industry desaster - for YouTube seems to be different than the usual sue-to-oblivion. It’s “we don’t sue, and you play nice“. YouTube is far too big and powerful for the media cartels to get into court with, so they don’t. YouTube hosts material that is copyrighted and not under fair use, no big player sues them, because the repercussions might be disastrous. Both sides have the weapons to destroy the other side, but no one will shoot.
Of course there’s another aspect (and I’m not saying this short blog post is in any way complete), and it’s the fact that copyright law gives media producers much more rights than they want to exercise; The result is that many people just don’t care about threatening YouTube users with lawsuits. Everybody knows YouTube is not cutting into profits, so why bother getting into the mud?
